They are very much aware of this but choosing not to answer.

But to be fair as Alex points out, it’s not down to CCBill to police copyright issues. The thing I have a problem with is how they can process for a company that no longer exists, that I would like to see an answer too.

Yes, that’s what I saying as well. However, from what I’m hearing, it’s a good chance that CCBill won’t answer to it if this has gone forward legally. Saying the wrong thing to us could affect the outcome perhaps. CCBill’s silence is concerning to me though.

A lot of research goes into the detailed posts I make. I also include links to validate information. When CCBill posts on their website "CCBill can take swift and serious action against any network user which may be in violation of copyright law…" I think they know what they are talking about and it’s obviously within their realm of responsibility.

Alex you are a bit ignorant regarding this topic. Spend some time and do your homework. Since I don’t think you know where to start I’ll provide you with a few basic links. 1 2 3 & #7 on this link

I also want to make it clear that I in no way see this as an adversarial situation with CCBill, it’s parent company CWIE, or Gary. Gary has always done right by me and CCBill has always seemed the gold standard to me in the adult industry. I don’t expect them to reply again regarding this topic, not because they are afraid to, or somehow liable, but because they’ve publicly acknowledged the information and they have a wealth of experience and knowledge in this industry. They know the Visa International guidelines regarding money laundering and they’ve gone to the 9th circuit court of appeals regarding DMCA issues. They’ve been in our industry for over a decade. They know what they are doing. Also notice on CCBill’s DMCA page that all complaints are handled directly by the VP of CCBill. They obviously take the DMCA issue very seriously.

There are simple steps that can be taken to escalate this issue if CCBill wasn’t honoring DMCA notices or if CCBill proves to not be in compliance with Visa International guidelines. There’s an officer appointed to address these specific kinds of issues and she’s been very public in her attendance of conferences and working closely with House Financial Services Committee Chairman Barney Frank (D-MA) regarding The Foreign Corrupt Practices Act, and a multitude of credit card processing related issues. In the end I think CCBill will drop ladslads.com for issues I’ve posted in this thread not pertaining to DMCA, but I’m sure those things take time to go through a process at CCBill & CCBill EU.

Until I see any of the producers, that I previously listed, posting that they’ve sent notices to CCBill for DMCA, that haven’t resulted in immediate take downs on ladslads.com, then I’m not going to provide information on how to escalate this further as there is currently absolutely no justification to do so!

So far NOT ONE of the producers with alleged infringing content on ladslads.com has posted that they’ve sent even ONE DMCA to CCBill, let alone that CCBill wasn’t acting on any DMCA notices. I say “alleged” because to date nobody from Pridebucks, IntenseCash, or any other studios/programs have said they’ve sent in DMCA’s!

Also, if you see content from Fratmen.TV, Fratpad.com or Squirtit.com on ladslads.com please let me know

Page 2 & 3 of this document expands on the CCBill repeat offender issue as does page 6 of this document. Notice on page 3 of the first document “the court found that claims of infringement made by a non-party are relevant to determining whether the termination policy has been reasonably implemented.”

As a condition of the DMCA safe harbor provision ISP’s are required to adopt and implement a repeat offender policy. They also lose immunity if they don’t act accordingly, or in a timely manner, to DMCA take down requests 17 U.S.C. Â§ 512©.

This thread has been active on Gaydemon since last Tuesday 6/29 and I haven’t seen any of the studios listed state that they’ve sent in DMCA’s to CCBill. I didn’t even see any of them thank you for posting links to their stolen content!

Regards of your copy/paste/linking abilities, I am correct in stating that there is no way they are going to go onto a forum and discuss the individual details of this or any client situation.

To believe that they can be baited into responding gives them very little credit.

I think people just want to see whether it’s being addressed or not. A few of us have mentioned that now. We’re not looking for exact details here. We just want to know whether CCBill is going to continue to process for a dummy company or not. I’m sure a quick post saying the issue is being looked into will suffice and I cannot see that putting CCBill in a bad spot legally.

This comes down to trust. Plain and simple. Silence and absence doesn’t help with gaining credit either.

Alex if you can’t even read, or remember, your own CCBill TOS then my “copy/past/linking” abilities can’t even help you.

To educate, or remind you, they clearly state in section 11 that under the DMCA CCBill is required to have infringing content removed once they recieve a proper notification.

In section 11 it also states that CCBill has the ability to determine who an “infringer” is and terminate agreements, without notice, if they believe you are a repeat infringer. Anyone who processes with CCBill must agree to those terms. You process with them so you must have read and agreed to the TOS.

This is also the case with the CCBill EU TOS.

You must be partying hard this weekend man! Have a good one. Time for us to go out and do our July 4th stuff and have a good time.

All this CCBill stuff that doesn’t seem to personally affect me right now, or evidently the listed studios themselves, is kind of a waste of my time and an excuse not to get some real work done

Here’s the DMCA list I sent to CCBill which they asked LadsLads to remove. LadsLads confirmed they had done it within an hour and I couldn’t see them anymore. Do they still work for you?

So, clearly they removed the copyright breaches I reported… but as a paying member they are now refusing to allow me to access their catalogue of pirated movies in case I report more copyright infringements.

This really sucks! How can I issue CCBill with further DMCA notices on a site I HAVE to pay access for but which denies me access to my own pirated films?

Good question. This thing gets dirtier all the time. I really wish we could just go to their host and have them unplugged. Only in a dream world though.
