I was watching some Sean Cody videos and noticed that they do not include a 2257 statement at the beginning or end of their videos. Being the mega site that they are I assume that Sean Cody has a good team of lawyers that have advised them on 2257 issues.
I always thought including the 2257 statement in a video was mandatory but perhaps it isn’t? Anyone here have a thought on this?
I realize that any question about 2257 compliance will usually be met with the standard “ask a lawyer” response but I thought I’d pose this question anyhow. Maybe someone here has already asked a lawyer about it and would be willing to share what they learned.
Or perhaps we can all follow the Sean Cody lead on the basis that their lawyers must have already addressed this?
Re: Are porn video clips supposed to include a 2257 statement?
I’m pretty sure the 2257 needs to be on the clips. We were confused that SC didn’t do it also. But we tend to err on the safe side of things, so we have always included them.
Re: Are porn video clips supposed to include a 2257 statement?
Is this in regards to clips both on and off your site? For instance, if your videos are hosted on a page with your 2257 does the clip still need it? I don’t see it on many site trailers at all but sponsor clips on XTube typically include it.
Re: Are porn video clips supposed to include a 2257 statement?
The short answer is yes. But, ones on your own site are covered by your site labeling. Once the vidoes go off your site, then they require labeling statment.
Re: Are porn video clips supposed to include a 2257 statement?
I doubt anyone will ever be prosecuted for failure to affix the required 2257 statement, but the lack of one would attract attention where you may otherwise be overlooked and used as an additional charge if you are caught doing something wrong. Like not having proof of insurance in your car – you won’t get stopped for it, but when you do, it will get added to a laundry list of charges.
It is easier to comply and stay out of trouble than get out of trouble.
